[1,2] The indictment in this case charged that the defendant sold, offered, for sale, or otherwise disposed of, spirituous, vinous, or malt liquors, contrary to law. On the trial a witness for the state was asked the question: “Well, did you get anything, either of you, over there?” Motion was made by the defendant to exclude that part of the answer to this question, “He said he got some whisky,” on the grounds that it was not responsive and was hearsay.
