The issues in this negligence action against the state of Oregon are related to, although not the same as, those before us in Stevenson v. State of Oregon, also decided today. In both cases the state is contending that, as a matter of law, it is not liable for injuries allegedly caused by the state’s creation of dangerous highway conditions. In Stevenson the state’s position was that it was immune from liability under the circumstances.
