In the spring of 1981, appellee, Dale Evans, purchased a parcel of land located on Christian Avenue in Concord Township, Lake County, Ohio. The land in question was heavily wooded and also had a small creek running through it. This creek was approximately six to eight feet wide and anywhere from three inches to one foot deep, depending on the time of year and the weather.

At approximately the same time he made this purchase, Evans decided to build a home on the property. Under the plans which Evans formulated, the house was to be set back in the woods, with the creek…
