The appellant instituted this action against the appellee,, seeking to recover judgment for injuries received by hint while in the employ of the defendant, caused by the gross, negligence, as he alleges, of the defendant. A description *359of the injuries received and of the negligence of defendant is sufficiently stated. He prayed judgment for $10,000.
