1 I. Defendant moved for a new trial upon the ground, among others, of newly discovered evidence, and now complains of the overruling of its motion as to that ground. Among the property insured is “printed books.” Plaintiff asks to recover for books claimed to have been destroyed, including twenty-four volumes .and index, Encyclopedia Britannica,, two hundred and forty dollars, and a large number of law books.
