David Puryear, Justice *851The Comptroller of Public Accounts (the "Comptroller") assessed franchise taxes against EBS Solutions, Inc. ("EBS"). Although EBS paid some of the taxes that were due, EBS did not pay the full amount before filing a suit seeking to recover the amount of taxes paid and seeking injunctive relief. See Tex.
