This suit was instituted in the county court of Collin county on March 15, 1917, by appellees O. E. Hood and E. T. N. Hood, doing business under the firm name of Hood Realty Company against appellant E. P. Harbin. The parties will be designated as in the trial court. Defendant interposed a plea of privilege, and the case was transferred to Ellis county. Defendant, on the 4th day of June, 1917, filed his original answer, consisting of a general denial only.
