MEMORANDUM OPINION

KATZ, District Judge.

Pending before this Court is Defendant’s Motion to Dismiss and/or Motion to Stay Proceedings (Doc. No. 3). For the following reasons, the Court will deny Defendant’s motion.

I. BACKGROUND

In April 2001 Defendant Carl Olm-stead was involved in an automobile accident in which he was struck by another vehicle.
