Affirming.

The appellant and defendant below, Bennie Patrick, was tried in the Magoffin circuit court under an indictment charging him with murdering his wife, Dora Patrick, with an axe, and was convicted by the jury of the offense of voluntary manslaughter and his punishment fixed at confinement in the penitentiary for 21 years.
