Appeal from a judgment of the Supreme Court at Special Term (Kahn, J.), entered January 19, 1981 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination by the Commissioner of the New York State Department of Civil Service denying petitioner’s request to declare invalid the results of an oral civil service examination.
