Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered May 19, 1998, convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the third degree.

Defendant pleaded guilty to a superior court information charging him with one count of criminal sale of a controlled substance in the third degree with the understanding that a sentence of IV2 to 4V2 years in prison would be imposed.
