The appellee sued the city for injuries received by her in December, 1869, from falling into an opening in the pavement of the sidewalk of one of the streets of the city, and recovered a verdict for five hundred dollars. In answer to interrogatories, the jury found the following facts: That the place in the city where the plaintiff received the injuries was in front of room number nine, Heath’s block, North Fifth street; that it was between the hours of ten and twelve o’clock in the forenoon; that she was of the age of seven years, four months, and twenty-three days; that the opening in the…
