Plaintiff, as agent of Melehoir Wadenphul, appeals from a judgment rejecting his demand for $450, which, he alleges, defendant, in violation of law and of the provisions of its charter, exacted and received from said Wadenphul in excess of the amount to which it was entitled for licenses .for the years 1909, 1910, and 1911, for a barroom for the sale of malt and vinous liquors exclusively in quantities less than five gallons, and where the gross sales amounted to less than $5,000.
