MINER, Circuit Judge:
Appellant United States of America appeals from an order granting a new trial, Fed.R.Crim.P. 33, entered in the United States District Court for the Southern District of New York (Martin, J.). The order was entered following the rendition of a jury verdict convicting defendant-appellee Carluin Sanchez (“Carluin”) of conspiracy to distribute and possess with intent to distribute heroin, in violation of 21 U.S.C. § 846, and possession of heroin with intent to distribute it, in violation of 21 U.S.C. §§ 812, 841(a)(1) and 841(b)(1)(B).
