Final hearing in this matter was had on June 28, 1963. At the outset of the hearing the court observed that there appeared from the pleadings no bona fide dispute, no genuine adversary proceeding to be heard by the court by way of declaratory decree. Thereupon the defendant city moved to amend its pleadings to take the position that its April 9, 1963, franchise election was invalid; that the proceedings by the city commission between the dates of February 19, 1963, and April 9, 1963, which led to the election, were invalid; that because of such alleged invalidity the…
