This declaratory action comes before the Court on motion for summary judgment filed by the plaintiffs, Greater New Orleans Broadcasting Association, Inc. (“broadcasters”) and cross motion for summary judgment filed by the defendants, the United States of America and the Federal Communications Commission (collectively “FCC”), both parties having agreed that this matter can be determined summarily.
