This appeal involves the scope of the authority of the State Health Planning Agency (SHPA) in administering the Certificate of Need (CON) program, OCGA § 31-6-40 et seq. The trial court dismissed HCA Health Services of Georgia, Inc.’s action against SHPA and its executive director for mandamus relief (Case No. S93A1898), and dismissed HCA’s action for judicial review under the Administrative Procedure Act (Case No. S94A0160). We affirm the dismissal of the action for judicial review (Case No. S94A0160) and reverse the trial court’s dismissal of the action for mandamus…
