This appeal is from a judgment in appellee’s favor for the sum of $lu,u00 as damages for injuries received by him under substantially the following circumstances: Appellee, together with a number of other members of a baseball nine, went to the station of Glazier, Hemphill county, early on the morning of the 5th day of April, 1909, with the view of taking passage on one of appellant’s trains to Roswell, N.
