CORRECTED DECISION ON MOTION TO MODIFY THE AUTOMATIC STAY

This matter comes before this court on the motion of Alexander J. Varveris (the “Movant”) who seeks the termination of the automatic stay pursuant to 362(d)(1) so that he may continue his action to foreclose his mortgage (the “Mortgage”) on property located at 64-05 215th Street, Bayside New York (the “Property”). That action is now pending in the Supreme Court State of New York, County of Queens (the “State Court”). For the reasons stated below, the motion is granted.
