This case involves a question of practice. The record shows that the appeal herein was taken from a judgment, rendered by the District Court of Ponce, ordering the dismissal of the proceedings. The said judgment was founded on the view that there had been a failure to comply with section 88 of the Code of Civil Procedure, in fact that more than one *147year had elapsed after the filing of the original complaint before the issuance of the summons required by law. Section 192 of the Code of Civil Procedure reads as follows:
