This is an appeal from a judgment of $3,000 recovered by appellee against appellant in a suit charging appellant with negligently causing the death of Alexander Moore. The evidence in the record discloses the following state of facts: On September 19, 1901, Moore and a companion, named James Tabor, drove a team, attached to a buggy, from their homes in the country to Springfield. Arriving in the city about five o’clock, they left their horses at a feed stable and, as testified by Tabor, began “ bumming around town.” They visited a number of saloons and took a number of drinks before calling…
