The School District filed suit in the District Court of Zavala County to set aside the decision of the Commissioner of Education of the State of Texas, affirmed by the State Board of Education, that appellee Briggs’ employment contract as superintendent with the School District was valid and binding and that he could be assigned only to the position of superintendent of the School District. Briggs filed a cross action seeking a writ of mandamus to compel the District to pay to him the amount due under his employment contract less certain deductions. Judgment was entered…
