Appeal by the relator, the Eden Musee Americain Company, Limited, from an order of the Supreme Court, made at the New York Special Term and entered in the. office of the clerk of the county of New York on the 26th day of November, 1900, quashing a writ of certiorari theretofore obtained by the relator.

O’Brien, J.:

The writ of certiorari was sued out by the relator to correct an assessment of 1899, made by the commissioners of taxes, amounting to $100,000, upon its capital stock and surplus.

The relator is a domestic corporation with a paid-up capital of $330,000. On the second Monday of January, 1899, its capital *283-consisted of a building erected sixteen years ago on leased land, at a cost of $243^929, and personal property to the amount of $31,400.
