KENYON, Circuit Judge.
This is an appeal from an order and decree of the District Court of the United States for the District of North Dakota, Western Division, dismissing for want of equity the complaint of appellant, trustee in bankruptcy of the estate of the Farmers’ Co-operative Elevator & Trading Company, asking the court to annul a certain note and mortgage held by appellees.
