In October, 1887, Conrad Beyel brought trespass on the case in the Circuit Court of Cabell county against the *539Newport News & Mississippi Yalley Railroad Company, to recover damages for bodily injury. lie alleges that he was traveling, in a one-horse wagon, along a public highway which crossed the defendant’s railroad, and while he was crossing it a locomotive ran against the wagon, whereby the horse became frightened and ran away, overturning the 'wagon, whereby he was thrown from it to the ground, and seriously injured.
