Plaintiffs sought declaratory and injunctive relief and monetary damages for an alleged violation of their rights under the Fair Housing Act, 42 U.S.C. § 3601 1 et seq., and under the Civil Rights Act of 1866, 42 U.S.C. § 1982. 2 The plaintiffs claimed that the defendants refused to rent an apartment to them on account of their race.
There are two issues. The first is the claimed inconsistency arising out of a jury verdict in favor of defendant Stephen Wolf, and a default judgment against defendant Metro Rental Services, Inc., of which Wolf was president.…
