This action was filed in the district court of Caddo county;, June 26, 1917, and plaintiff, Charles Bern- dorf, prays that a deed, absolute on its face, be declared a mortgage; prays an accounting for rents and profits, and that he be permitted to redeem the lands.

Pearl O. Thorpe and Mayme Wyatt, defendants, are the heirs of Hiram T. Dayton, deceased.
