Appeal from an order of the County Court of Albany County (Breslin, J.), entered July 28, 2006, which classified defendant as a risk level three sex offender pursuant to the Sex Offender Registration Act.

Defendant pleaded guilty in 2005 to sexual abuse in the second degree of a four-year-old child and was sentenced to a one-year jail term. Upon completion of his sentence, the Board of Examiners of Sex Offenders prepared a risk assessment instrument pursuant to the Sex Offender Registration Act (see Correction Law art 6-C), calculating a score of 135 points, including 30 points under the risk…
