Defendant - appellant - cross - appellee Aelred Lippold appeals and plaintiff-appel-lee-cross-appellant Donald R. Jermosen cross-appeals from a judgment entered in the United States District Court for the Western District of New York (John T. Elfvin, Judge), granting Jermosen’s motion for judgment non obstante veredicto (“j.n.o.v.”) in part, and denying it in part, following a jury trial.
