Brief of counsel for appellant contains so plain and fair a statement of the facts in the case that we adopt it here: “Marie Grandjean died intestate in Dawson county on the 3d day of January, 1902. She left no children, but did leave surviving her Axel Grandjean, her husband, who is the appellant, and three brothers, who are the appellees.
