Appeal by the defendant,. Charles M. Warner, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 30th day of August, 1918, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 9th day of September, 1918, denying defendant’s motion for a new trial made upon the minutes.

This is an action at law to recover $50,000, alleged to be the reasonable value of services performed by plaintiff for defendant under an employment to enable defendant to acquire the control of or title to a plant capable of producing gasoline. It is alleged that it was agreed that if plaintiff should bring defendant and those in control of such a plant together, and defendant should acquire it, a corporation should be organized to take over the control of or title to the plant, and defendant would pay plaintiff, in stock of the company acquired or organized, the reasonable…
