Lucy E. York brought an action of assumpsit against the Central Illinois Mutual Relief Association in the circuit court of Champaign county. The defendant pleaded the general issue and special pleas, but the condition of the pleadings is immaterial in view of a stipulation of the parties that the cause be tried by the court without a jury upon the stipulated facts, which constituted all the evidence' in the case, and that the question whether any cause of action-or defense was shown should be determined by the court without reference to the state of the pleadings.
