Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered December 21, 2009, convicting defendant upon his plea of guilty of the crime of assault in the second degree.

Defendant was charged in an indictment with robbery in the first degree, robbery in the second degree, assault in the second degree and grand larceny in the fourth degree. He thereafter pleaded guilty to assault in the second degree in full satisfaction of the charges, in return for a sentence of no more than 5V2 years in prison.
