*524In an action to recover damages for personal injuries, etc., the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Nassau County (Mahon, J.), entered December 5, 2003, as granted that branch of the motion of the defendant Town of Hempstead which was for leave to reargue that branch of its prior motion which was for summary judgment dismissing the complaint insofar as asserted against it, and, upon reargument, granted that branch of the motion.

Ordered that the order is affirmed insofar as appealed from, with costs.
