Appeal from, Tama District Court. — Hon. L. Gr. Kinne, Judge. This is an action on a policy of insurance issued by defendant. There was a trial by jury, and verdict and judgment for plaintiff. The defendant appeals.

— The petition alleges that defendant is a corporation for pecuniary profit, duly organized under the laws of the state of Iowa; that on the fifteenth day of December, 1884, it issued the policy in suit, and thereby insured Crenshaw & Day against loss or damage by fire or lightning, to the amount of three thousand dollars, on their grist-mill, including building and machinery, said policy to be in force so long as the assured should remain members of the defendant corporation.
