Appellant Caribbean Lumber Company appeals from the order granting appellee Phoenix Assurance Company of New York’s motion for summary judgment and denying summary judgment to appellant.

This is an action on an insurance policy; suit was brought to recover damages to a shipment of lumber, additional shipping and stevedoring expenses, and penalties for the loss and reasonable attorney fees pursuant to OCGA § 33-4-6.
