The plaintiff claims that he was employed by the defendant Lucy M. George in the month of December, 1910, to recover for her one hundred and sixty shares of stock of the S. George Company, of which she claimed she had been deprived by fraudulent practices of other parties. At the time of the. employment, according to the contention of the plaintiff, Mrs. George proposed to give him for his services, and he accepted *539the offer, ten shares of stock of the S.
