The record clearly establishes that the defendant, Stanley D. Rose, and companion, Donald F. Carr, were discovered by two law enforcement officers in the midst of burglarizing a commercial establishment in Che-halis, Washington on June 21, 1970. In the melee which ensued, the record also shows, Mr. Rose fired several shots from a 9 mm. Browning automatic pistol in the direction of each of the two officers. Mr. Rose, in turn, was ultimately struck by a bullet fired from the gun of one of the officers, ceased firing, was apprehended and subsequently sent to a hospital in an ambulance.
