The notice of appeal in this case prescribes an appeal upon questions of law and fact, but for the reasons hereinafter mentioned this court has determined that this is not a chancery case within the meaning of Section 6, Article IV of the Constitution, and is therefore not retriable upon the facts. The appeal is effective only as an appeal upon questions of law.
This is an action by a corporation against certain of its former directors and other officers for damages alleged to have been caused by their negligent and unauthorized acts.
