This is an appeal from a judgment entered pursuant to an order of the Ramsey County District Court in favor of defendant Metropolitan Council. Plaintiff, the city of New Brighton, sought a declaratory judgment requiring the Metropolitan Council and the Metropolitan Sewer Service Board 1 to acquire New Brighton Sewer Improvement No. 67-8. The district court ordered judgment denying relief, from which the city of New Brighton appeals.
