This is an appeal from a judgment of the County Court of Madison County, rendered November 7, 1968, upon a verdict convicting defendant of the crime of robbery in the first degree.

During the morning of March 9, 1968, Charles Bauer, a 66-year-old chicken farmer, was found dead in front of the garage on his property off the Schoolheimer Road in the City of Oneida.
