Plaintiff Biljana Krklus (plaintiff), as the administrator of the estate of her late husband Frank Krklus (Krklus), brought a medical malpractice action against defendants Dr. Robert Stanley and Rush Prudential Health Plans, Stanley’s employer. Plaintiff alleged that Stanley negligently failed to diagnose Krklus’ aortic dissection which ruptured, causing his death. Defendants denied liability and raised comparative negligence as an affirmative defense.
