This suit was brought in the Pulaski Chancery Court by appellant to “foreclose a mortgage against appellees. The note and mortgage were executed on December 20, 1927. The summons was issued and served on the appellees more than 20 days, and no answer had been filed, and the appellant filed motion to enter judgment and decree.

The appellees filed a response to said motion, and, among other things, alleged that the answer was not due under § 1 of act 21 of the Acts of the G-eneral Assembly of 1933. Section 1 of said act reads as follows: “Answers in suits to foreclose mortgages, deeds of trust…
