In 1855 Moses F. Smith engaged the services of John W. Crockett, an attorney at law practicing in the Henderson circuit court, to prosecute a suit for him in said court against Archibald Dixon and A. B. Barrett, for the recovery of a large tract of land on the Ohio river in Henderson county, then *439in their possession, and estimated to be worth $45,000 or $50,000.
