RARDALL, C. J".,

delivered the opinion of the court.

The plaintiff in error was indicted at the Fall Term, 1869, of the Circuit Court for Yolusia county. The indictment charges that “ M. M. Morgan, late of said-, laborer, not having the fear of God before his eyes, but being moved and seduced by the instigation of the devil, on or about the 8th day of May, A. D. 1869, did, in the peace of God and of the State of Florida, then and there being, wilfully and feloniously take, steal and carry away one calf, the property of James H. Prevatt.
