Presently before the Court is a Motion to Dismiss filed by Defendant Allstate In*432surance Company (“Allstate”). (Doc, 10.) For the reasons that follow, Allstate’s Motion will.be granted in part and denied in part.
I. Background
The weil-pleaded facts as set forth in' Plaintiffs Complaint (Doc. 1-1) are as follows:
