Wright, Sir Melvin Jr.

Court of Criminal Appeals of Texas

Decided October 5, 2016No. PD-1137-15PublishedCited by 50 opinions

1Opinion of the CourtKeller, P.J.

in which MEYERS, KEASLER, HERVEY, RICHARDSON and YEARY, JJ., joined.

On direct appeal from the revocation of “regular” community supervision, appellant contended that his sentence was illegal. Before us, appellant contends that the court of appeals erred in applying the ha-beas harm analysis from Ex parte Par-rott1 to his case on direct appeal. We reject appellant’s complaint because his illegal-sentence claim on direct appeal from his revocation proceeding was a collateral attack on the judgment from the original plea proceeding. Consequently, we affirm the judgment of the court of appeals.
