The State has appealed on a reserved question of law from an order of the Honorable Crestón B. Williamson, entered in Oklahoma County District Court, Case No. CRM-81-3994, sustaining the demurrer (more properly denominated a motion for a directed verdict) of the defendant, Terrance Lee Smith, and dismissing the charge of Operating a Motor Vehicle While Under the Influence of an Intoxicating Liquor.
