Memorandum: Defendant appeals from a judgment convicting him following a jury trial of attempted murder in the second degree (Penal Law §§ 110.00, 125.25 [1]), robbery in the first degree (Penal Law § 160.15 [1]) and two counts each of criminal use of a firearm in the first degree (Penal Law § 265.09) and criminal possession of a weapon in the third degree (Penal Law § 265.02 [4]), arising from robberies of the Bayberry Seafood Store on July 21, 1995 and the Salvation Army Thrift Store on August 26, 1995.
