This matter comes on upon the filing by Nelson White Construction Management Corporation (Nelson White) of a Complaint to enforce a mechanic’s lien and upon the filing by W. Marshall Tuck and Peggy Tuck (Tucks), Defendants herein, of a Motion to dismiss the Plaintiff’s Complaint on the ground that this Court does not have subject matter jurisdiction over the mechanic’s lien action.
